Jurisdiction in Online Infringement Case

In Marot Image Ltd. v. Reut Electronics the Jerusalem District Court ruled that a copyright owner may sue for infringement in the domicile of a business that showed the infringing pictures.

 

The defendant in the case is a Haifa company that built websites for several businesses, one of which had a branch in Jerusalem. The plaintiff, the Israeli representative of the US company Getty Images (an international licensor of photographs, which was an additional plaintiff) filed suit in Jerusalem. The defendant filed a motion to dismiss the suit for lack of personal jurisdiction.

 

Honorable Judge Shapira, presiding over the case held that since one of the infringing websites is of a company that operates also in Jerusalem, the infringing act has occurred in Jerusalem, and therefore the Jerusalem courts have personal jurisdiction over the defendant.
